Full Spectrum Laser Terms and Conditions of Purchase

Thank you for shopping with Full Spectrum Laser (“FSLaser”). These Terms and Conditions of Purchase (the “Terms”) apply to your use of the fslaser.com website (“Website”) and purchase of any products from FSLaser. You also accept these Terms when you create an account, make a purchase as a guest, or log in to the Website.

1.Information on Our Site

We try to be as accurate as possible with the information we present on the Website. We will make reasonable efforts to accurately display the attributes of the products we sell. We do not warrant that product descriptions or other content is accurate, complete, or error free. Prices and promotions are subject to change. We cannot confirm the availability or price of an item until you place your order. Despite our best efforts, sometimes a product found on our Website may not be available, the offer may have been misstated, or an item may be mispriced. For any of these reasons, we may cancel your order or we may contact you for instructions on the order.

2.Order Confirmation

Our order confirmation provided through our Website does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. At any time after receipt of your order, we may accept, decline, or place quantity or other limits on your order for any reason. We may impose these limits on a per-person, per-order, or any other basis. If we reject, limit, or otherwise modify your order, we will attempt to notify you using the email address you provide to us. If we cancel an order or part of an order that we've already charged you for, we’ll refund you the full amount of the canceled portion of the order.

3.Disclaimers and Limitation of Liability

FSLASER IS NOT AWARE OF ANY USE OR PURPOSE THAT YOU HAVE FOR THE PRODUCTS PURCHASED PURSUANT TO THESE TERMS AND MAKES NO REPRESENTATION OR WARRANTY THAT THE PRODUCTS PURCHASED WILL MEET YOUR REQUIREMENTS OR PERFORM ADEQUATELY UNDER THE CONDITIONS IN WHICH YOU USE THEM. YOU MUST READ AND FOLLOW ALL INSTRUCTIONS AND WARNINGS PROVIDED WITH THE PRODUCTS. YOU ACCEPT ANY AND ALL LIABILITY FOR, AND SHALL PROTECT, DEFEND, INDEMNIFY AND HOLD FSLASER HARMLESS FROM AND AGAINST, ANY AND ALL CLAIMS, DIRECTLY OR INDIRECTLY, ARISING OUT OF ANY PROPERTY DAMAGE, HARM, LOSS, PHYSICAL ILLNESS, INJURY, OR DEATH CAUSED BY YOU, YOUR EMPLOYEES, OR YOUR AGENTS’ USE OF THE PRODUCTS.

THE FOLLOWING LIMITED WARRANTY IS THE SOLE REMEDY AVAILABLE FOR ANY DEFECT IN ANY OF THE PRODUCTS SOLD UNDER THESE TERMS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FSLASER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ATTRIBUTABLE TO YOUR USE OF ANY PRODUCT PURCHASED UNDER THESE TERMS.

4.Limited Warranty and Returns

The Limited Warranty excludes shipping and consumables and other normal wear and tear items. All electronic items (control cards, power supplies, motors) and most mechanical items are covered under the included warranty and extended warranty unless damaged by abuse/fires. Consumables not covered include, but not limited to, rubber parts such as tubing, belts, plastic wheels, lenses, mirrors, other optics, and laser tubes.

Unless otherwise stated, FSLaser warrants to the original purchaser that the laser products identified on the invoice that accompany these Terms (the “Products”) are free from defects in material or workmanship, under normal use for a period of 30 days from the date of product received under the following conditions:

Our 40W/45W Muse and Hobby CO2 lasers have a 100% money back guarantee (minus shipping and handling costs) if you return your unit in like-new condition within 30 days of the date product was received. This warranty covers only the main laser unit and excludes optional accessories. If for some reason a part of the laser unit is damaged in transit, we will promptly send out a replacement part free of charge. We will also replace defective parts on dead on arrival (DOA) parts with complimentary shipping (except machines sold FOB Las Vegas) but we do not refund shipping charges on units returned for refund (includes defective on arrival parts/units).

Due to their large size and effort in crating/packaging, our refunds for our Professional, Muse Fiber, Muse Titan, Muse UV, and MC Series lasers will deduct a 20% restocking fee plus shipping fee for returns if returned within 30 days in new condition. Any parts damaged in transit will be promptly replaced free of charge.

All optional accessories, including optional extra lenses, beam combiners, air purifiers, and rotary attachments, have a 20% restocking fee unless otherwise noted in writing.

FSLaser does not warrant that the software operation of the Product will be uninterrupted or error-free, or that all such errors may be corrected. This Limited Warranty does not apply to:

1. damage caused by use with another product;
2. damage caused by accident, abuse, misuse, liquid contact, fire, or other external cause;
3. damage caused by operating the Product outside the instructions and warnings provided with the Products;
4. Products which had their electronic module housings opened or otherwise tampered with; and
5. defects caused by normal wear and tear or otherwise due to the normal aging of the Product, or if any serial number has been removed or defaced from the Product.

If your Product is defective, return it, at your expense (unless specifically excluded), with an RMA number to the address provided below within 30 days of the date product is received. All units or accessories returned for repair, replacement, or refund require an RMA number and shipping charges are the responsibility of the purchaser (including defective on arrival parts/units). This Limited Warranty is limited to the original purchaser and only applies to purchases made directly from FSLaser. Purchases made by 3rd parties including 3rd party leasing companies may have their own set of terms and conditions - please contact the 3rd party vendor directly for any inquiries.

This warranty is valid for purchases made directly from FSLaser. The warranty is non-transferable. REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE EXCLUSIVE REMEDY OF THE CONSUMER. EXCEPT FOR THE WARRANTIES CONTAINED IN THIS LIMITED WARRANTY, FSLASER MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR BY LAW, WHETHER OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE OR OTHERWISE. YOUR SOLE AND EXCLUSIVE REMEDY UNDER THIS LIMITED WARRANTY SHALL BE PRODUCT REPAIR OR REPLACEMENT AS PROVIDED HEREIN. FSLASER SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. FSLASER IS NOT RESPONSIBLE FOR ANY LOSS OF SOFTWARE PROGRAMS, DATA OR OTHER INFORMATION CONTAINED ON THE STORAGE MEDIA OR ANY OTHER PART OF THE SERVICED PRODUCTS.

Units picked up or shipped on a customer's shipping account are considered sold Freight on Board (FOB) Las Vegas and excluded from complimentary shipping for warranty purposes. Any replacement parts or returns are made available for pickup in Las Vegas, NV, or may be shipped on a customer's shipping account, if requested, or will be charged for shipping costs when sold FOB Las Vegas.

Full Spectrum Laser is not responsible for any additional fees or taxes associated with international shipments.  You will be responsible for prompt payment of all additional taxes and fees.

5.Disputes

In the event that any dispute or claim arises out of or relating in any way to these Terms, or to any Products sold to You by FSLaser, including, but not limited to, any alleged defect or deficiencies of those Products, the advertising of or sales practices relating to such Products, delivery, installation, and any communication, by whatever means, between you and FSLaser (the “Dispute”) then You and FSLaser agree to the following Alternative Dispute Resolution procedure. Prior to initiating any arbitration, as set forth below, the parties both agree to submit the Dispute to mediation in Clark County, Nevada utilizing JAMS, or any other mutually-agreed mediator. You and FSLaser also agree that both parties will each pay half of the fees and costs for such mediation. If the parties are unable to resolve the Dispute through this mediation, then you and FSLaser each agree that the entire Dispute will be resolved by binding, individual arbitration, rather than in court.

BY AGREEING TO ARBITRATION, YOU AND FSLASER UNDERSTAND THAT EACH IS AGREEING TO WAIVE ITS RIGHT TO SUE OR GO TO COURT TO ASSERT OR DEFEND THEIR RIGHTS UNDER COMMON LAW OR THIS CONTRACT. THE RULES IN ARBITRATION ARE DIFFERENT THAN THOSE OF A COURT. BOTH PARTIES ACKNOWLEDGE THAT THEY ARE EXPRESSLY WAIVING THE RIGHT TO A JURY.

To begin an arbitration proceeding, you must send a demand to JAMS, 3800 Howard Hughes Parkway, 11th Floor, Las Vegas, NV 89169, describing your claim(s) and serve a copy of the demand on our registered agent Henry Liu, 6216 S Sandhill Rd, Las Vegas, NV, 89120. The arbitration will be conducted in Clark County, Nevada by JAMS under its then-current rules, including the JAMS Streamlined Arbitration Rules & Procedures. These rules and the form for filing an arbitration claim are available at www.jamsadr.com/rules-streamlined-arbitration. Payment of all filing, administration and arbitrator fees will be governed by these rules.

You and FSLaser each agree that any dispute resolution proceedings of any nature will be conducted only on an individual basis and not in a class, consolidated or representative action. This means that you may not purport to act on behalf of a class or any other person. Likewise, an arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. Any claim that all or part of this class action waiver provision is invalid or unenforceable may be determined only by a court and not by an arbitrator. If a court decides that the limitations of this paragraph are deemed invalid or unenforceable, any putative class or representative action must be brought in a court located in Las Vegas, Nevada and not in arbitration. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial, unless such waiver is unenforceable. This means that any claim would be decided by a judge, not a jury.

6.Applicable Law

The Federal Arbitration Act and the laws of the state of Nevada, without regard to principles of conflict of laws, will govern these Terms and apply to any Disputes between You and FSLaser.

7.Miscellaneous

The remedies of the parties hereunder are cumulative and in addition to all rights and remedies at law and in equity. No delay in exercising or failure to exercise a right or remedy shall impair that or any other right or remedy or be construed as a waiver of any such right or remedy. These Terms contain the entire agreement of the parties relating to the subject matter of Your purchase of the Products and supersede all prior and contemporaneous agreements, understandings, usages of trade and courses of dealing. These Terms may be altered or amended only by written agreement. If any provision of these Terms shall be held void or unenforceable, the remaining provisions shall remain in full force and effect. Your binding electronic signature by clicking the “I accept” box on the Website at the time of purchase shall be deemed an original and be binding upon You.
